Terms of Service

1. Acceptance of terms

By creating an account or using SocialAgent you agree to these terms. If you do not agree, do not use the service.

2. Your account

You are responsible for keeping your login secure and for activity under your account. You must be at least 16 years old to use SocialAgent.

3. Acceptable use

You agree not to use SocialAgent to publish content that is unlawful, infringes someone else’s rights, or breaches the platform policies of Instagram, Threads or X. You are responsible for the content you publish, including content drafted with AI assistance and approved by you.

You also agree not to use the service to send automated bulk or spam content, to circumvent platform rate limits, or to publish to accounts you are not authorized to operate.

4. Your AI keys and your content

You supply your own AI provider key and are responsible for complying with that provider’s terms and for the costs it incurs. You retain ownership of the content you create and publish. We claim no licence to it beyond what is needed to operate the service on your instruction — storing it, rendering it, and publishing it to the accounts you connected.

5. Third-party platforms

Publishing depends on Instagram, Threads and X, whose APIs, limits and policies we do not control and which can change or become unavailable without notice. SocialAgent is not responsible for a platform rejecting, removing or rate-limiting your content, or for restrictions a platform places on your account.

6. Approval and automation

Approval is required by default and nothing publishes without it. If you explicitly enable automatic publishing on a schedule, you accept responsibility for the content published under it. Pre-publish safety checks reduce but do not eliminate the risk of publishing something you would not have approved.

7. Plans, allowances and billing

The Free plan is available at no cost within its published allowances. Paid plans are billed in advance and renew automatically until cancelled. You can cancel at any time from your workspace settings; after cancellation you move to Free plan allowances at the start of the next cycle. Allowances are enforced per calendar month, and automated work stops when an allowance is exhausted.

“Unlimited” posts and brand workspaces are subject to fair use: they are meant for one business or creator publishing at a normal human pace. To protect your accounts from the platforms’ spam limits, and the service for everyone, publishing to one account, or from one workspace in a short period, has a safety ceiling well above normal use; posts past it wait and go out once the window frees up. We may contact you about sustained use far beyond typical volumes.

8. Founding waitlist offer

The first 100 unique, valid email addresses successfully registered on the SocialAgent waitlist qualify for 50% off the standard SocialAgent subscription price for the lifetime of that subscription. The offer is tied to the email address used to join, is limited to one place per person, and is not transferable. It applies to the SocialAgent subscription fee, excluding taxes, usage-based charges and third-party costs. We will send redemption details to the registered email address when paid subscriptions become available.

9. Service availability

We work to keep SocialAgent available but do not guarantee uninterrupted service, and we offer no uptime SLA on the Free or Pro plans. Scheduled publishing depends on third-party platforms whose availability we do not control.

10. Suspension and termination

We may suspend or terminate an account that breaches these terms, abuses the service, or puts our platform integrations at risk. Where practical we will tell you first and give you an opportunity to export your data.

11. Limitation of liability

SocialAgent is provided “as is”. To the extent permitted by law we are not liable for indirect, incidental or consequential damages, for lost profits or goodwill, or for content published from your account. Nothing in these terms limits liability that cannot be limited under applicable law.

12. Changes to these terms

We may update these terms from time to time. We will notify you of material changes by email or in the app. Continued use after a change takes effect means you accept the updated terms.

13. Governing law

These terms are governed by Austrian law, without prejudice to mandatory consumer protection rights in your country of residence.
